The terms governing use of ProSystem products and this website. Full terms apply.
Agreement
By using ProSystem products or this website, you agree to these terms. If you're using ProSystem on behalf of an organisation, you confirm you have authority to do so, and "you" means that organisation.
Our service
We provide ProSystem BMS, eCommerce websites, custom software and related services. Specific scope, deliverables and timelines live in a signed Statement of Work (SoW) or order form.
Your responsibilities
- Keep your account credentials safe. You're responsible for activity under your account.
- Use the service lawfully. No reverse engineering, no unauthorised access, no abuse.
- Provide accurate information for invoicing and support.
Your data
Data you put into ProSystem belongs to you. We process it under your instructions per the SoW and our Privacy Policy. You can export your data at any time.
Website data and third-party tools
Our website uses analytics, advertising measurement, conversion tracking and security tools, including Meta Pixel, Meta Conversions API and Cloudflare Turnstile. These are described in our Privacy Policy and Cookie Policy.
Fees
Fees are set out in your order form. Invoices are due within the period stated there. Late payment may result in suspension after written notice.
Service levels
We aim for ≥99.5% monthly availability of hosted services. Scheduled maintenance is communicated in advance. Specific service commitments are defined in your support agreement if applicable.
Warranties & liability
We provide the service with reasonable skill and care. To the fullest extent permitted by law, our aggregate liability under or in connection with these terms is limited to fees paid by you in the twelve months preceding the claim.
Termination
Either party may terminate for material breach not cured within 30 days of written notice. On termination, you retain access to your data for 30 days to export; after that, we delete it.
Governing law
These terms are governed by the laws of Bangladesh. Disputes are resolved in the courts of Dhaka.
